Accountants handle some of the most sensitive personal and financial data that exists. Tax returns, payroll records, bank statements, business financials — all of it falls under strict professional confidentiality obligations, and much of it is also regulated under data protection law.

As AI tools become central to accounting workflows, a critical question has emerged: can accountants use AI tools like ChatGPT or Claude with client data, and still comply with GDPR?

Why GDPR Applies to AI Use

GDPR applies whenever you process personal data — and "processing" is defined broadly to include transmitting, storing, analysing, or otherwise handling data. When you paste a client's name, tax reference number, or financial details into an AI tool, you are processing their personal data.

The key requirements under GDPR for this kind of processing are:

Sending client financial data to an AI tool constitutes a transfer to a third-party data processor. Under GDPR, this requires a Data Processing Agreement (DPA) with the AI provider — and most free-tier AI tools don't offer this.

The Data Processing Agreement Problem

Under GDPR Article 28, when you use a third-party service to process personal data on your behalf, you must have a written Data Processing Agreement in place. This agreement must specify what data is processed, how it's processed, what security measures are in place, and how long it's retained.

Most consumer AI tools — including the free versions of ChatGPT and Claude — do not offer DPAs. Enterprise plans typically do, but at significantly higher cost. Without a DPA, using these tools with client data is a technical violation of GDPR.

What Data Minimisation Means for AI

Even if you have a DPA in place, GDPR's data minimisation principle requires that you only process personal data that is actually necessary for your purpose. This creates a useful framework for thinking about AI use: before putting data into an AI tool, ask whether the AI actually needs that specific information to complete the task.

In many cases, the answer is no. If you're asking an AI to help draft a client letter, it doesn't need your client's actual name — it can work perfectly well with a placeholder. If you're analysing financial trends, the AI doesn't need the real account numbers.

The Practical Solution: Anonymise Before Sending
