The Hidden Risk of Pasting Client Data into AI Tools
It happens dozens of times a day in law firms, accounting practices, and medical offices around the world. A professional opens ChatGPT or Claude, pastes in some client information — a name, a case number, a medical history — and gets a useful response in seconds.
What most of them don't realise is that they've just transmitted sensitive client data to a third-party company's servers. And in many cases, that transmission carries real legal and professional risk.
Where Does Your Data Actually Go?
When you type or paste text into an AI chat tool, that text is sent over the internet to the AI company's servers, processed by their models, and a response is returned. The key question is: what happens to your data after that?
The answer varies by platform and plan, but the default settings on most consumer AI products allow the provider to use your conversations to improve their models. This means your client's name, their medical condition, their financial situation, or their legal case could theoretically be used as training data for future AI systems.
The Three Categories of Risk
Professional obligations. Lawyers, accountants, doctors, and financial advisors all operate under professional duties of confidentiality. These duties generally require you to take reasonable steps to protect client information. Sending that information to a third-party AI provider — especially without your client's knowledge — may fall short of that standard.
Data protection law. If you handle data from EU residents, GDPR applies. GDPR requires a legal basis for processing personal data and restricts transfers to third parties without appropriate safeguards. Similar rules apply under CCPA in California and a growing number of state privacy laws.
Regulatory requirements. Healthcare professionals face HIPAA. Financial advisors face FINRA and SEC requirements. Lawyers face bar rules. Each of these regulatory frameworks has specific requirements around how client data is handled and shared.
